1. Acceptance of Terms
By creating an account, accessing, or using AccessAudit ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and the individual developer operating AccessAudit ("we", "us", "our") at accessauditai.com. We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance. We will notify you of significant changes by email.
2. Description of Service
AccessAudit is an automated web accessibility scanning platform. The Service: • Scans web pages for accessibility violations using axe-core and other automated checks • Provides AI-generated fix suggestions for detected violations • Generates accessibility reports, share links, and audit certificates • Tracks fix progress and compliance scores over time • Sends automated monitoring alerts when scores drop The Service is provided to freelancers, web developers, and agencies operating primarily in the European Union.
3. Limitation of Liability — Automated Scanning
IMPORTANT: Please read this section carefully. Automated scanning detects only a subset of WCAG violations. AccessAudit and its automated tools can detect approximately 40–60% of programmatically detectable accessibility issues. The remaining issues require manual expert testing. The audit reports and certificates generated by AccessAudit: • Confirm that an automated accessibility audit was performed on a specific URL at a specific time • Are NOT a legal certification of WCAG compliance • Are NOT a substitute for a manual accessibility audit by a qualified expert • Do NOT guarantee that the scanned website meets legal requirements under the European Accessibility Act (EAA), ADA, Section 508, or any other regulation We are not liable for: • Any fines, penalties, or legal claims arising from reliance on AccessAudit reports as proof of legal compliance • Accessibility violations that automated tools cannot detect • Inaccurate or incorrect AI-generated fix suggestions • Any damages resulting from implementing AI-suggested code fixes without expert review By using the Service, you acknowledge that full WCAG compliance requires manual expert testing in addition to automated scanning.
4. Permitted Use
You may use AccessAudit to: • Scan websites for which you are the owner or have explicit written authorization to test • Generate accessibility reports for your clients • Share public report links with clients and stakeholders • Use AI-suggested fixes as a starting point for manual developer review You must NOT use AccessAudit to: • Scan websites without authorization from the site owner • Use scan results to harass, extort, or threaten website owners • Attempt to circumvent rate limits, scan limits, or payment requirements • Resell or redistribute the Service without prior written agreement • Use the Service for any unlawful purpose • Attempt to reverse-engineer, scrape, or overload the Service infrastructure
6. Accounts and Plans
Account registration: You must provide accurate information when creating your account. You are responsible for maintaining the confidentiality of your password and for all activity under your account. Plans and billing: Paid plans (Dev, Agency) are billed monthly through Paddle. Pricing is displayed on the pricing page and may change with 30 days' notice to existing subscribers. Cancellation: You may cancel your subscription at any time from Settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods. Plan limits: Scan limits reset on the first day of each calendar month. Unused scans do not roll over to the next month. Account termination: We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.
7. AI-Generated Fix Suggestions
AccessAudit uses the Anthropic Claude API to generate code fix suggestions for detected accessibility violations. You acknowledge that: • AI-generated fixes are suggestions, not guaranteed solutions • All suggested code must be reviewed by a qualified developer before implementation • We do not warrant that AI-suggested fixes are correct, complete, or appropriate for your specific codebase • Implementing AI-suggested code without review may introduce bugs, security vulnerabilities, or other unintended consequences Every AI fix suggestion displayed in the interface includes a disclaimer and confidence score for this reason.
8. Intellectual Property
AccessAudit and its content, features, and functionality (including the web application, design, reports, and certificates) are owned by us and protected by applicable intellectual property laws. You retain ownership of: • Your account data • The websites you scan • Any content you create using reports as a starting point You grant us a limited, non-exclusive license to store and process your scan data solely to provide the Service. Open-source components: AccessAudit uses axe-core (Deque Systems, MPL 2.0 license) and other open-source libraries. Their respective licenses apply.
9. Data Protection
Processing of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy. As a user who scans third-party websites, you act as a data controller with respect to any personal data that may appear in HTML snippets extracted from those sites. You are responsible for ensuring your use of the Service complies with applicable data protection law, including GDPR.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT: • The Service will be uninterrupted or error-free • Scan results will be accurate, complete, or current • The Service will meet your specific accessibility compliance requirements • AI-generated fixes will be correct or suitable for your codebase
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: • Loss of profits or revenue • Regulatory fines or legal penalties • Costs of implementing incorrect AI-suggested fixes • Data loss or corruption • Business interruption Our total aggregate liability to you for any claims arising from your use of the Service shall not exceed the total fees paid by you to AccessAudit in the 12 months preceding the claim, or €50, whichever is greater. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Serbia (or the EU member state of the operator's residence), without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If that fails, disputes shall be subject to the exclusive jurisdiction of the competent courts. If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr
